The Democratic Alliance (DA) has celebrated a significant victory following the Western Cape High Court’s decision to grant an urgent interdict preventing Dr. John Hlophe from taking up a seat on the Judicial Service Commission (JSC). The DA, which brought the application, hailed the ruling as a crucial win for the integrity and independence of South Africa’s judiciary.

The court’s decision, delivered this week, bars Hlophe from joining the JSC, the body responsible for selecting judges. The DA argued that Hlophe, who was impeached and found guilty of gross misconduct, should not be allowed to participate in such a critical institution. “This ruling is a major step in safeguarding the independence and credibility of our judicial system,” said DA National Spokesperson Karabo Khakhau.

The DA believes that allowing Hlophe to influence the selection of future judges would have undermined public trust in the judiciary and compromised democratic principles. The party had long maintained that Hlophe’s appointment to the JSC would have been a blow to the integrity of South Africa’s courts, especially given his impeachment after a protracted and controversial legal process.

“This decision affirms our position and strengthens the fight to maintain the highest standards of integrity within our judiciary,” Khakhau added, emphasizing that the ruling serves as a victory for all South Africans who believe in a fair and impartial legal system.
